Terms of Service

1. General

Sellr is a Danish webshop platform that makes it easy for individuals and small businesses to sell physical goods online. By creating an account with Sellr, you accept these terms and conditions.

Sellr.dk is operated by Philip Kartin (CVR 46085108).

2. Account Creation and Use

When creating an account, you must provide accurate information. You are responsible for keeping your login credentials confidential and for all activity on your account.

Only one account per person/business is permitted unless otherwise agreed.

3. Seller Responsibility

As a seller on Sellr, you are solely responsible for:

• Ensuring that the products you sell are legal and comply with Danish law
• Ensuring that product descriptions and images are truthful and do not infringe on others' rights
• Complying with rules on sales, purchases, and complaints (Consumer Sales Act, etc.)
• Handling payment, shipping, and customer service with your customers
• Correctly collecting and reporting any VAT to the Danish tax authorities

4. Prohibited Goods and Activities

The following is not permitted on Sellr:

• Illegal goods (drugs, weapons, stolen goods, etc.)
• Goods that infringe copyright or trademarks (counterfeit goods, piracy)
• Goods that are dangerous or do not meet safety requirements
• Pornographic or violent content
• Misleading or fraudulent behavior

AI-Generated Content

Products and content primarily created using generative AI (artificial intelligence) are not permitted on Sellr. This includes, but is not limited to:

• Images generated by AI tools (DALL-E, Midjourney, Stable Diffusion, etc.)
• Text and descriptions generated by language models without substantial human editing
• Digital products consisting solely of AI-generated material

Sellr reserves the right to determine, at its sole discretion, whether content is AI-generated, and to remove such content without notice. This determination may be based on technical analysis, metadata, or other indicators.

Sellr reserves the right to remove products and suspend accounts that violate these rules without notice.

5. Payments

Sellr does not directly process payments. Payments occur directly between buyer and seller via MobilePay or other payment methods offered by the seller.

Sellr has no responsibility for payment disputes between buyers and sellers.

6. Terms for Buyers

When you place an order on Sellr, you accept the following:

Private Sales

Most sellers on Sellr are private individuals, not businesses. This means purchases on Sellr are typically private sales between individuals (C2C), similar to buying via classified ads or Facebook Marketplace.

For private sales, consumer protection laws regarding right of withdrawal and warranty do not apply, unless the seller is a registered business.

Payment Process

• The order is an agreement between you and the seller
• Payment is made manually via MobilePay to the seller's phone number
• You must send the payment yourself with the order ID as the message
• The seller confirms payment and ships the item

Order Rejection

• The seller can reject your order before you have paid (e.g., if the item is sold out)
• If your order is rejected after payment, the seller must refund the amount
• Refunds are processed via MobilePay back to you

Returns and Complaints

Since most transactions are private sales, you generally have no statutory right of withdrawal or warranty. Any agreements about returns or complaints should be made directly with the seller before purchase.

If the seller is a registered business (CVR), normal consumer rules apply.

Your Responsibility as Buyer

• Review the product description carefully before buying
• Ask the seller questions if you are uncertain
• Be aware that items may be handmade or used

Disputes

Any disputes between buyer and seller are handled between the parties. Sellr is not a party to the transaction and cannot mediate disputes.

7. Pricing and Subscription

Free

Sellr offers a free subscription with the following limits:

• Up to 25 active products (you can create unlimited, but only 25 can be visible at a time)
• Up to 10,000 DKK in annual turnover

When these limits are reached, you can continue to run your existing page, but you cannot expand with more active products until you upgrade.

Sellr Ekstra

For sellers who grow beyond the free limits, we offer Sellr+ subscription:

• 99 DKK/month or 800 DKK/year (all prices excl. VAT)
• Unlimited active products
• Unlimited turnover
• Custom domain option

Payment for Sellr+ is processed via card (Stripe). Sellr.dk is not VAT-registered, so prices are without VAT.

8. Termination

You can terminate your account at any time by contacting us. Upon termination, your webshop will be closed and your data deleted after a reasonable period (typically 30 days).

Sellr reserves the right to terminate or suspend accounts that violate these terms.

9. Disclaimer

Sellr is provided "as is". We strive to keep the platform available and functioning correctly, but cannot guarantee uninterrupted operation.

Sellr cannot be held liable for:

• Lost revenue or profit due to downtime or errors
• Content uploaded by users
• Disputes between buyers and sellers
• Errors by third parties (payment providers, hosting, etc.)

10. Rights

The Sellr platform and all associated software is owned by Sellr. Content you upload (product images, descriptions, etc.) remains your property, but you grant Sellr the right to display this content on the platform.

By using Sellr, you grant us permission to use your store name and screenshots for marketing purposes.

11. Changes

Sellr may change these terms with reasonable notice. Significant changes will be communicated via email. Continued use of the platform after changes constitutes acceptance of the new terms.
